End-User License Agreement

for “IX Web Analytics Connector for Google” Community Edition (TIBCO Spotfire Ecosystem)

This End-User License Agreement (EULA) is a legal agreement between you (either an individual or a single entity) and the mentioned AUTHOR (Infomatix BV) of this Software for “IX Web Analytics Connector for Google – Community Edition” for the TIBCO Spotfire ecosystem identified above, which includes computer software and may include associated media, printed materials, and “online” or electronic documentation (“SOFTWARE PRODUCT”).
By installing, copying, or otherwise using the SOFTWARE PRODUCT, you agree to be bounded by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the SOFTWARE PRODUCT.



SOFTWARE PRODUCT is being distributed as Freeware for personal, commercial use, non-profit organization, and educational purpose. You are NOT allowed to make a charge for distributing this Software (either for profit or merely to recover your media and distribution costs) whether as a stand-alone product, or as part of a compilation or anthology, nor to use it for supporting your business or customers. It cannot be distributed on any website or through any other distribution mechanism without the written permission of the AUTHOR.


This EULA grants you the following rights: Installation and Use. You may install and use an unlimited number of copies of the SOFTWARE PRODUCT. Copies of the SOFTWARE PRODUCT cannot be distributed as a standalone product or included with your own product. The SOFTWARE PRODUCT cannot be included in any free or non-profit packages or products.


Limitations on Reverse Engineering, Decompilation, Disassembly and change (add, delete or modify) the resources in the compiled the assembly. You may not reverse engineer, decompile, or disassemble the SOFTWARE PRODUCT, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.



The SOFTWARE PRODUCT is licensed as a single product. Its component parts may not be separated for use on more than one computer.



You may permanently transfer all of your rights under this EULA, provided the recipient agrees to the terms of this EULA.


This Agreement shall be effective as from the date of the installation of the SOFTWARE PRODUCT and it shall remain in force for an indefinite term.

Without prejudice to any other rights, the Author of this Software may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the SOFTWARE PRODUCT and all of its component parts.


You acknowledge that no maintenance or support will be provided for this software. You have no right to receive any upgrades, patches, enhancements, bug fixes, new versions or new releases of the software.


The AUTHOR of this Software expressly disclaims any warranty for the SOFTWARE PRODUCT. The SOFTWARE PRODUCT and any related documentation is provided “as is” without warranty of any kind, either express or implied, including, without limitation, the implied warranties or merchantability, fitness for a particular purpose, or no infringement. The entire risk arising out of use or performance of the SOFTWARE PRODUCT remains with you.


In no event shall the author of this Software be liable for any special, consequential, incidental or indirect damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use this product, even if the Author of this Software is aware of the possibility of such damages and known defects.


All title and copyrights in and to the SOFTWARE PRODUCT (including but not limited to any images, photographs, clipart, libraries, and examples incorporated into the SOFTWARE PRODUCT), the accompanying printed materials, and any copies of the SOFTWARE PRODUCT are owned by the Author of this Software. The SOFTWARE PRODUCT is protected by copyright laws and international treaty provisions. Therefore, you must treat the SOFTWARE PRODUCT like any other copyrighted material. The licensed users or licensed company can use all functions in the SOFTWARE PRODUCT to create new report templates.


You acknowledge that the software is subject to U.S. export control laws, including the U.S. Export Administration Act and its associated regulations, and may be subject to export or import regulations in other countries. You agree to comply strictly with all such laws, and shall obtain any export, re-export, or import authorizations required by the United States or other applicable jurisdictions. You represent and warrant that you are not located in any U.S. embargoed country, under control of, or a national or resident of any such country or on the U.S. Treasury Department’s list of Specially Designated Nationals or the U.S. Department of Commerce Denied Persons List or Entity List.

You shall not engage in activities associated with nuclear, chemical or biological weapons or missiles for delivering such weapons, or involve any persons or entities on the US Bureau of Industry and Security Denied Parties List or Entity List, the US Office of Foreign Assets Control List of Specially Designated Nationals and Blocked Persons, the EU list of persons and entities specified in Council Regulation (EC) No. 881/2002, or any similar lists maintained by other countries.

This EULA including the above copyright notice shall be included in all copies of the SOFTWARE PRODUCT.
